THESE TERMS CONTAIN IMPORTANT LIABILITY LIMITATIONS AND DISPUTE
RESOLUTION PROVISIONS THAT AFFECT YOUR LEGAL RIGHTS. BY USING THIS PLATFORM, YOU AGREE TO BE BOUND BY THESE TERMS.
Welcome to Meetin10.com ("Platform", "Service", "we", "us", or "our"). These Terms and Conditions ("Terms") govern your use of our event listing and attendee connection platform operated by [MEET IN 10].
BY CHECKING THE "I AGREE" BOX, CREATING AN ACCOUNT, OR USING OUR PLATFORM, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. If you disagree with any part of these Terms, you may not access the Service.
1. DEFINITIONS
"Event Organizer" or "Organizer" means any person or entity that creates, lists, promotes, or manages events on the Platform
"Attendee" means any person who views, registers for, or attends events listed on the Platform"User" means any person who accesses or uses the Platform, including Organizers and Attendees
"Event" means any gathering, activity, or experience listed on the Platform
"Content" means any information, data, text, images, videos, or other materials posted on the Platform
2. PLATFORM ROLE AND LIMITATIONS
2.1 Technology Provider Only
Meetin10.com is a technology platform that enables Event Organizers to list events and connect with potential attendees. Unless explicitly stated otherwise for specific events, we are NOT the organizer, host, or operator of events listed on our Platform. We do not own, control, or manage any events, venues, or activities advertised through our Service.
Exception for Company-Organized Events: In limited circumstances, Meetin10.com may organize and host our own events (such as marketing events, user meetups, or platform demonstrations). When we are the actual event organizer, this will be clearly indicated on the event listing and in all related communications. For such events where we are explicitly identified as the organizer, standard event organizer responsibilities and liabilities apply to us directly.
2.2 No Event Responsibility
Except for events where Meetin10.com is explicitly identified as the organizer, we disclaim any responsibility for:
The safety, quality, legality, or accuracy of any event
The conduct of Event Organizers or Attendees
The accuracy of event information, descriptions, or advertising
The delivery of promised services or experiences at events
Any interactions between Users, whether online or offline
2.3 Third-Party Relationships
For events organized by third parties, all contractual relationships are directly between Event Organizers and Attendees. We are not a party to these relationships and have no obligations under any agreements made between Users. For events where Meetin10.com is the organizer, standard organizer-attendee contractual relationships apply directly with us.
3. USER RESPONSIBILITIES
3.1 Event Organizers Must:
Obtain all necessary licenses, permits, and insurance for their events
Comply with all applicable laws and regulations
Provide accurate and truthful event information
Handle all aspects of event planning, execution, and safety
Be solely responsible for attendee safety and wellbeing
Maintain appropriate insurance coverage for their eventsImplement proper safety measures and protocols
3.2 Attendees Must:
Verify event details independently before attending
Assume all risks associated with event attendance
Comply with event rules and organizer instructions
Behave respectfully toward other attendees and organizers
3.3 All Users Must:
Provide accurate information about themselves
Be at least 18 years old or have parental consent
Not use the Platform for illegal activities
Respect the rights and safety of othersNot engage in harassment, discrimination, or abusive behavior
3.4 Insurance Requirements
EVENT ORGANIZERS ARE STRONGLY ADVISED TO OBTAIN APPROPRIATE INSURANCE COVERAGE for their events, including but not limited to:
General liability insurance
Professional liability insurance
Event cancellation insurance
WE DO NOT PROVIDE ANY INSURANCE COVERAGE for events listed on our Platform. WE ARE NOT RESPONSIBLE for verifying insurance coverage or ensuring adequate protection.
4. PROHIBITED ACTIVITIES
4.1 API and Technical Restrictions
Users may not:
Access our APIs without authorization
Exceed rate limits or abuse our technical infrastructure
Use automated tools (bots, scrapers) without permissionAttempt to reverse engineer our platform
Create competing services using our data or technology
Interfere with the platform's operation or other users' access
4.2 General Prohibited Activities
Users may not:
Post false, misleading, or fraudulent information
Organize or promote illegal activities
Engage in harassment, stalking, or threatening behavior
Violate any applicable laws or regulationsInfringe on intellectual property rights
Use the Platform for commercial spam or unauthorized advertising
Attempt to circumvent Platform security measures
5. CONTENT AND INTELLECTUAL PROPERTY
5.1 User Content
You retain ownership of content you post but grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content for Platform operations.
5.2 Platform Ownership
All Platform technology, design, and proprietary features remain our exclusive property.
5.3 Content Monitoring
We reserve the right to review, edit, or remove content that violates these Terms or applicable laws, but we have no obligation to monitor all content.
5.4 Digital Millennium Copyright Act (DMCA)
We comply with the DMCA and respond to valid takedown notices. If you believe your copyright has been infringed:
DMCA Takedown Process:
Send written notice to: info@meetin10.com
Include: (a) identification of copyrighted work; (b) identification of infringing material; (c) your contact information; (d) statement of good faith belief; (e) statement of accuracy under penalty of perjury; (f) your physical or electronic signature
Repeat Infringer Policy: We will terminate accounts of users who are repeat copyright infringers.
Counter-Notification: If you believe content was wrongly removed, you may submit a counter-notification following DMCA procedures.
6. DISCLAIMERS AND LIMITATION OF LIABILITY
6.1 NO WARRANTIES
THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
6.2 NO LIABILITY FOR EVENTS
EXCEPT FOR EVENTS WHERE MEETIN10.COM IS EXPLICITLY IDENTIFIED AS THE ORGANIZER, WE ARE NOT LIABLE FOR ANY DAMAGES, INJURIES, LOSSES, OR CLAIMS ARISING FROM:
ATTENDANCE AT ANY EVENT LISTED ON THE PLATFORMACTIONS OR OMISSIONS OF EVENT ORGANIZERS
INTERACTIONS BETWEEN USERS, INCLUDING ASSAULT, HARASSMENT, OR OTHER HARMFUL CONDUCT
CANCELLATION, POSTPONEMENT, OR CHANGES TO EVENTS
MISREPRESENTATION OF EVENT DETAILS OR SERVICES
SAFETY INCIDENTS AT EVENTS OR VENUES
FINANCIAL LOSSES RELATED TO EVENT ATTENDANCEFor events where we are the explicit organizer, standard event organizer liability applies, subject to applicable law and any specific terms provided for such events.
6.3 LIMITATION OF DAMAGES
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO USE OUR PLATFORM IN THE 12 MONTHS PRECEDING THE CLAIM.
FOR SPECIFIC CLAIM TYPES, OUR LIABILITY IS FURTHER LIMITED AS FOLLOWS:
Platform outages or technical issues: Limited to service credits or refunds
Third-party content or user interactions: $0 liability (except for our gross negligence)
Data incidents: Limited to amounts required by applicable law
Event-related claims: $0 liability unless we are the explicit event organizer
THIS LIMITATION DOES NOT APPLY TO:
OUR GROSS NEGLIGENCE OR WILLFUL MISCONDUCT
DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE
FRAUD OR FRAUDULENT MISREPRESENTATION
VIOLATIONS OF APPLICABLE CONSUMER PROTECTION LAWS WHERE LIMITATION IS PROHIBITED
ANY LIABILITY THAT CANNOT BE LIMITED BY APPLICABLE LAW
6.4 DATA SECURITY LIMITATIONS
WE IMPLEMENT REASONABLE SECURITY MEASURES CONSISTENT WITH INDUSTRY STANDARDS. HOWEVER, NO SYSTEM IS COMPLETELY SECURE. TO THE EXTENT PERMITTED BY LAW:
WE ARE NOT LIABLE FOR UNAUTHORIZED ACCESS THAT OCCURS DESPITE OUR REASONABLE SECURITY MEASURES
YOU ACKNOWLEDGE THE INHERENT RISKS OF DATA TRANSMISSION OVER THE INTERNET
WE ARE NOT RESPONSIBLE FOR THIRD-PARTY BREACHES OF EXTERNAL SERVICES
OUR LIABILITY FOR DATA INCIDENTS SHALL BE LIMITED TO THE GREATER OF:
(a) amounts required by applicable law; or (b) amounts paid by you in the 12 months preceding the incident
Data Breach Response: In the event of a security incident affecting your personal information, we will provide notification and assistance as required by applicable law and will cooperate with reasonable remediation efforts.
6.5 Consumer Protection Compliance
WE ACKNOWLEDGE THAT CERTAIN CONSUMER PROTECTION LAWS MAY PROVIDE RIGHTS THAT CANNOT BE WAIVED BY CONTRACT. Where such laws apply:
These Terms will be interpreted to comply with applicable consumer protection requirements
Mandatory consumer rights under applicable law remain in full effect
If any provision conflicts with mandatory consumer protection law, the law governs
You may have additional rights under your local consumer protection laws
If you are a consumer, you may be entitled to additional protections under the consumer laws of your jurisdiction that cannot be modified by these Terms.
6.6 EXCLUSION OF DAMAGES
WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, EXCEPT WHERE SUCH EXCLUSION IS PROHIBITED BY APPLICABLE LAW.
7. INDEMNIFICATION
7.1 User Indemnification
TO THE EXTENT PERMITTED BY LAW, you agree to indemnify, defend, and hold harmless Meetin10.com, its officers, directors, employees, and agents from THIRD-PARTY claims, damages, or expenses DIRECTLY arising from:
Your MATERIAL AND WILLFUL breach of these Terms
Your INTENTIONAL violation of applicable law
Content you post that ACTUALLY infringes third-party rights (after final judicial determination)
PROVEN harm caused by your INTENTIONAL OR RECKLESS interactions with other Users
THIS INDEMNIFICATION IS LIMITED TO:
$50,000 maximum per incident for individual users
Reasonable costs and damages actually incurred
Claims where you had actual notice of the problematic conduct
THIS INDEMNIFICATION DOES NOT APPLY TO:
CLAIMS ARISING FROM OUR GROSS NEGLIGENCE OR WILLFUL MISCONDUCT
CLAIMS WHERE YOU ACTED REASONABLY AND IN GOOD FAITH
ANY INDEMNIFICATION PROHIBITED BY APPLICABLE LAW
CLAIMS INVOLVING CIRCUMSTANCES BEYOND YOUR REASONABLE CONTROL
7.2 Event Organizer Additional Indemnification
Event Organizers additionally agree to indemnify us against any claims related to:
Events they organize or promote
Safety incidents at their events
Misrepresentation of event details
Failure to obtain proper permits or insurance
Any harm to attendees or third parties
8. PRIVACY AND DATA PROTECTION
Our Privacy Policy, incorporated by reference, governs how we collect, use, and protect your personal information. By using the Platform, you consent to our privacy practices as described in our Privacy Policy.
9. TERMINATION
9.1 User Termination
You may terminate your account at any time by contacting us or using account deletion features.
9.2 Our Termination Rights
We may suspend or terminate your access immediately for:
Violation of these Terms
Illegal or harmful activities
Safety concerns
Fraudulent behavior
Any reason we deem necessary to protect our Platform or users
9.3 Effect of Termination
Upon termination, your right to use the Platform ceases immediately. Provisions regarding liability limitations, indemnification, and dispute resolution survive termination.
10. DISPUTE RESOLUTION
10.1 Informal Resolution
Before initiating any legal proceedings, you agree to first contact us at info@meetin10.com to attempt informal resolution. Both parties will engage in good faith discussions for 30 days.
10.2 Binding Arbitration
PLEASE READ THIS SECTION CAREFULLY - IT AFFECTS YOUR LEGAL RIGHTS
Agreement to Arbitrate: Except for disputes resolved in small claims court or injunctive relief for intellectual property violations, you and Meetin10.com agree to resolve all disputes through binding arbitration rather than courts.
Class Action Waiver: YOU AND MEETIN10.COM AGREE THAT DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS ONLY. Neither party may participate in class actions, collective actions, or representative proceedings.
Arbitration Rules: Arbitration will be conducted under the Commercial Arbitration Rules of the American Arbitration Association (AAA). The arbitration will take place in New York unless both parties agree otherwise.
Batch Arbitration for Similar Claims: If 25 or more similar claims are filed within a 90-day period, they will be resolved through batch arbitration as follows:
Claims will be grouped into batches of up to 50 claims each
One arbitrator will be appointed per batch
Each batch will have one hearing and one decision
Bellwether cases: The parties may select a small number of representative cases to be resolved first, with results informing potential settlement of remaining claims
This process applies only to substantially similar claims with common factual or legal issues
Costs: Each party pays their own attorney fees. If you demonstrate that arbitration costs would be prohibitively expensive compared to court costs, we will pay the difference. For users qualifying for in forma pauperis status in federal court, we will advance your AAA filing fees. For batch arbitrations, filing fees will be allocated among claimants in each batch.
Fee Protection: If the arbitrator determines that our dispute resolution procedures or requirements are unfair or applied in bad faith, we will pay your reasonable attorney fees up to $5,000.
Opt-Out Right: You may opt out of this arbitration agreement by emailing info@meetin10.com within 60 days of accepting these Terms. Your opt-out must include your name, email address, and clear statement that you opt out of arbitration.
10.3 Governing Law
These Terms are governed by Delaware law, without regard to conflict of law principles. Any disputes not subject to arbitration will be resolved in the courts of New York.
11. INTERNATIONAL USE
11.1 Global Platform
Our Platform is available worldwide, but Users must comply with their local laws and regulations.
11.2 Local Compliance
Event Organizers are responsible for ensuring their events comply with all applicable local, national, and international laws.
11.3 Export Controls
Users must comply with all applicable export control and sanctions laws.
11.4 Regulatory Compliance
Users are solely responsible for compliance with all applicable laws and regulations in their jurisdiction, including but not limited to:
Event licensing and permitting requirements
Health and safety regulations
Tax obligations
Consumer protection laws
Anti-discrimination laws
Data protection regulations (GDPR, CCPA, etc.)
We make no representations about the legality of events or activities in any jurisdiction.
12. MODIFICATIONS
12.1 Terms Updates
We may modify these Terms to reflect changes in law, our business, or Platform features. MATERIAL CHANGES (defined as changes that significantly expand our rights or reduce your protections) will be communicated as follows:
Email notification to your registered addressProminent notice on the Platform for 30 daysRequirement to re-accept Terms before continued use
NON-MATERIAL CHANGES (such as clarifications or minor updates) may be made with notice on our Platform. Your continued use after 30 days constitutes acceptance of non-material changes only.
12.2 Service ChangesWe reserve the right to modify, suspend, or discontinue any aspect of the Platform at any time.
13. GENERAL PROVISIONS
13.1 Entire Agreement
These Terms constitute the entire agreement between you and Meetin10.com regarding Platform use.
13.2 Severability
If any provision is found unenforceable, it shall be modified to the minimum extent necessary to make it enforceable while preserving its intent. If modification is not possible, the provision shall be severed, and the remainder of these Terms remain in effect.
Specific Severability Rules:
If liability limitations are deemed too broad, they shall be enforced to the maximum extent permitted by law
If arbitration provisions are partially unenforceable, the enforceable portions remain in effect
If indemnification clauses are excessive, they shall be limited to reasonable amounts and scope
The essential commercial terms (liability limitations, dispute resolution, platform role definitions) are fundamental to this agreement. If any such provision cannot be enforced in substantially similar form, either party may terminate this agreement.
13.3 Waiver
Failure to enforce any provision does not waive our right to enforce it later.
13.4 Assignment
We may assign these Terms without notice. You may not assign your rights without our consent.
13.5 Force Majeure
We are not liable for failures due to circumstances beyond our reasonable control.
13.6 Electronic Records
You consent to receive these Terms and all communications electronically. We will maintain records of your acceptance of these Terms, including the version accepted and date of acceptance. You acknowledge that electronic signatures and records have the same legal effect as handwritten signatures and paper records.
14. SAFETY AND REPORTING
14.1 Safety Resources
We encourage Users to prioritize safety and report concerning behavior through our reporting mechanisms.
14.2 Emergency Situations
In emergency situations, contact local authorities immediately rather than relying on Platform reporting features.
14.3 Cooperation with Authorities
We may cooperate with law enforcement investigations as required by law.
15. PAYMENT PROCESSING
15.1 Third-Party Payment Processors
We use third-party payment processors (such as Stripe, PayPal, etc.) to handle transactions.
WE ARE NOT RESPONSIBLE FOR:
Payment processor errors, delays, or failures
Credit card or payment disputes between users and payment processors
Payment processor fees or charges
Security of payment information once transmitted to processors
15.2 Transaction Disputes
All payment disputes must be resolved directly with the event organizer and/or payment processor. We are not a party to any financial transactions between users.
15.3 Refunds and Cancellations
Refund policies are set by individual event organizers. We do not guarantee refunds for any events or services purchased through the Platform.
